Copyright terms
1.1 Copyright
The copyright and any other Intellectual Property Rights in the photograph(s) shall vest in and remain the exclusive property of the photographer, to the extent provided by the Finnish Copyright Act. Title and ownership to the physical raw files of the photograph(s) shall remain the sole property of the photographer.
1.2 Royalty-free license (RF)
The client shall be granted a royalty-free license (RF) to the material it has ordered, in the form it has been delivered in. The client shall have a non-exclusive license, that covers all medias, to the material without a time limit. The license to the material extends to all companies in the same group of companies as the client, as defined according to the Finnish Accounting Act in force from time to time.
The client may not sell or otherwise assign the material transferred to it to a third party without the written consent of the supplier. However, the client may transfer the material to a third party for e.g. the client’s own marketing, communication or PR purposes or for producing material intended for these purposes. All other use of the material must be separately agreed upon with the photographer. If special terms have been agreed upon with the client, such terms shall be listed in section 3.9 of this agreement.
The photographer may sell the material to a third party, add the material to the public photo archive of Kuvio and use the material in its marketing. The photographer guarantees that before the delivery of the photos, the third party obtaining a license to the material shall undertake to follow good journalistic practices in connection with publishing the photos, and to respect the right of integrity of the designer/architect.
